Is the House of the People of Oklahoma Going to Do the Right Thing?

The House of Representatives is intended to be close to the people and vulnerable should they not follow the general will of the populace. The two year terms and smaller districts make it vastly easier to take one of them down if they have a bad voting record. For this reason the Constitution of the State of Oklahoma says the purse strings are kept in the House, with all revenue raising bills originating in the House.

This is going to be a major factor in the negotiations for a special session, Mary Fallin knows better than to schedule a special session without having an agreement in advance and it appears that House leadership has executed a hard U turn from the tax and spend policy of the 2017 Legislative session. Last week the McCarville Report (may his corrupt RINO butt rot in hell) jumped the gun claiming that a deal was in for Mary Fallin's billion dollar tax increase plan but a letter sent out this week by Doerflinger said otherwise and inside sources are saying that House leadership has had their come to Jesus moment and is going to hold the line on new taxes and tax increases.

Thank God we have cops. One that I know tells people that he is a garbage collector and in a way that is an apt description, taking the garbage off the streets so that society can be a bit safer. I know it is a hard job and many of the men and women doing the task are good and decent people doing the best they can.

And then there is this coward who shot down a mentally ill man for no reason at all. Yeah, the guy was mentally ill, yeah he had a sheath knife in a scabbard on his hip, but the guy was walking down the street minding his own business till some do good-er called in and said the guy was acting strange. Yah think? He is crazy. Officer James Moore simply executed a mentally ill man because he wasn't capable of understanding or was just too damned crazy to comply with screamed commands.

Prater Melt Down Continues?

  Sources are saying that Oklahoma County D.A. David Prater has found himself in deep trouble over the handling of both the Hoffmiester/Fount Holland charges and the Daniel Holtzclaw case. Last week we went over some of the allegations and this week more sources came forward and more awkward questions were asked. Oklahoma Attorney General Mike Hunter is said to be breathing hard down Prater's neck and putting together a case of potentially criminal over reach.

Is it far behind?
  Prater himself has issued an email to staff asking for any cases going forward with involvement of the former DNA expert, with some local attorneys saying that once the case breaks it will make the Joyce Gilchrist scandal look like a small thing.

  Not that they care as paying back the donor class is always first on their mind but Governor Fallin and House and Senate leadership is looking pretty darned stupid after the stinging defeat at the Supreme Court on SB 845, the cigarette tax passed in the waning days of the 2007 legislative session. This ruling leaves a two hundred million dollar hole in the 2018 budget and will likely mean a special session short of miraculous improvement in tax income in the next few weeks. We are talking $30,000 a day in direct costs of running a special session and it would require the session last more than one week due to the Constitutional prohibition on passing revenue raising bills in the final five days of a session. Worse, the agenda will be set by Governor Fallin, the lame duck RINO herself. Not many people are going to expect her to call for cutting government waste or useless commissions or departments, all that tramp knows is raising taxes and raising fees.

  At issue in these cases is if the Oklahoma citizenry has the power to dictate what the legislature can and cannot do. SQ 640 passed in 1992 hobbled the legislature and demanded a ¾ majority to pass revenue raising bills or a vote of the people. The Supreme court has ruled that it is not to parse the language as lawyers but to read the Constitution as a lay person would as it is a strict instruction to Oklahoma Government as to the will of the people. At issue is over ten billion dollars in new taxes that can be passed by a 51% vote of the legislature.

  The John Birch Society has tagged former two term Oklahoma State Rep Dan Fisher to be their candidate in the 2018 Gubernatorial race. Fisher is a favorite at John Birch Society events and while he has an excellent Oklahoma RINO Index score for his two terms as state rep his close ties to the John Birch Society are especially troublesome.
The Birchers', as they are known, have a long history of controversy including racism, extremism, and are counted as a fringe group upon the far right. While outright racist opinions from the group itself are generally difficult to document they did oppose the 1964 Civil Rights Act by calling it a communist plot to destroy America.

Loses Another Major Case
  Oklahoma County D.A. David Prater suffered another set back to his political agenda after being forced to dismiss charges against five major political figures inculding State School Superintendent Joy Hofmeister. The charges concerned the election for state school superintendent, allegations of dark money and collusion, yet the charges weren't filed for some time and many political insiders thought it was Prater just trying to influence the election.
Fount Holland, Stephanie Milligan, Steven Crawford, and Lela Odom were also charged. Prater had claimed that the five colluded to steer dark money into private independent PACs that were attacking opponents. Despite 2014 being the time of the alleged infractions the charges weren't filed until November of 20016 and the preliminary hearing wasn't set until August 16th of this year but Prater hadn't distributed any police or investigative reports to the defense attorneys, meaning they hadn't been able to look at the evidence and prepare their defense.

  Prater dropped the charges on Tuesday, alluding to the possibility that the charges could be refiled in the future and alluding to "additional information" that had come to light in the past few months. However that would be a reason to postpone a preliminary hearing, not drop the charges. The reality is that Prater was simply attempting to save face with the general public as those in the know understand just what a stinging defeat this is to Prater.

The tape is quite boring to listen to, about twenty one minutes of Terri White speaking or on hold with the Sheriff's 911 dispatchers. But in the taped phone call Commissioner Terri White admits to walking up to her brother who was seated at a table and throwing water in his face, a domestic violence battery under Florida law. As it should be as such crazy behavior causes retaliation by the victim.


Worse, Commissioner White committed this act of domestic violence in the presence of children, multiple minors, and she herself babbles on the tape about how despicable it is to use domestic violence in the presence of children. Had Commissioner White committed this act of domestic violence in Oklahoma she would have been arrested for the act for both the domestic violence and for committing an act of domestic violence in the presence of children.
